Terms of service
Effective date: 20 October 2026
These Terms of service (the “Terms”) govern your access to and use of tenders.gy, including our website, applications, tender listings, award information, alerts, AI-powered matching and related services (collectively, the “Service”). The Service is owned and operated by Topaz Interactive (“Topaz Interactive”, “tenders.gy”, “we”, “us” or “our”), a web development agency based in Georgetown, Guyana.
1. Acceptance of these Terms
By creating an account, purchasing a subscription, accessing or using the Service, you agree to these Terms, our Privacy policy, Refund and cancellation policy and Disclaimer. If you use the Service for a business or other organization, you represent that you have authority to accept these Terms on its behalf.
If you do not agree to these Terms, do not access or use the Service.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Service. You may not use the Service if doing so would violate applicable law or if we have previously suspended or terminated your access.
3. The Service
tenders.gy is a procurement discovery and monitoring platform. We aggregate tender notices and other procurement opportunities from public-sector bodies, private companies and institutions across Guyana and provide tools that may include search, filtering, personal and shared saved searches, tracked tenders, public bid openings and award histories, supplier tracking, notifications, AI-powered matching and team collaboration.
Features, sources, limits and availability vary by plan and may change as the Service develops. The current inclusions for each plan are shown on our Pricing page.
3.1 Installed web app
On supported devices you can install tenders.gy as a web app. Installation is optional, uses the same account and plan, and does not create a separate subscription or grant additional plan features. Internet access is required; installation does not provide offline access to account pages. Browser and operating-system support may vary.
Installing the app does not automatically enable notifications. Removing it does not cancel your subscription, close your account or delete server-held information. Manage billing and notifications separately and use our Data Deletion page for deletion requests.
3.2 Alerts and saved searches
Email, WhatsApp and push alerts depend on plan eligibility, current access, your account-level delivery choices and, where applicable, an individual saved-search subscription. WhatsApp requires a verified number and opt-in; push requires browser or device permission. Each team member manages their own destinations and subscriptions. Saved-search alerts begin with newly published matching tenders after subscription, rather than sending a backlog.
Alerts can be delayed, blocked, duplicated or unavailable because of source updates, connectivity, provider or device settings, or technical faults. “Instant” describes the intended alert timing, not a guarantee of receipt. You remain responsible for checking relevant notices and deadlines.
4. Procurement information
Listings on the Service are provided for discovery and convenience. The original notice, procurement documents, addenda and instructions issued by the buyer remain authoritative. You must verify requirements, eligibility, closing dates, submission methods and contact details with the original source before taking action.
We do not guarantee that every procurement opportunity will be listed or that every listing, alert, summary, classification or source link will be complete, accurate, current or available. Additional limitations are explained in our Disclaimer.
5. AI matching and automated features
AI-powered matching and other automated features use information from your business profile, preferences and procurement listings to identify potentially relevant opportunities. Results may include errors, omit a relevant opportunity or surface an irrelevant one.
AI output is not professional advice, an eligibility assessment, a recommendation to bid or a prediction of success. You are responsible for reviewing the original documents and making your own procurement and business decisions.
6. Accounts and security
6.1 Accurate information
You must provide accurate, current and complete information and keep it updated. You may not impersonate another person or organization or create an account using information you are not authorized to use.
6.2 Account security
You are responsible for safeguarding your login credentials and for activity under your account. Tell us promptly at hello@tenders.gy if you believe your account has been accessed without authorization.
6.3 Team accounts and seats
If your plan includes multiple seats, the account owner or authorized administrator may invite users to the organization. Each person must use their own account. The organization is responsible for its users, their permissions and their compliance with these Terms. Seats may not be shared outside the subscribing organization.
Private saved searches and shared team searches have different visibility. Sharing a search makes its name and criteria available to authorised team members with the relevant Business Profile access. Search creators and the subscribing account owner may have management rights under the available controls. Do not share confidential search criteria unless you are authorised to do so. Losing team membership, profile access or plan eligibility may stop access to shared resources and their alerts. Sharing a search does not give other members control of your personal alert destinations.
7. Starter and Pro plans
We offer Starter without a subscription fee and Pro with base, 2X and 4X capacity options. Starter includes the features described on our Pricing page, including an optional weekly discovery email and Standard support. Pro adds the paid features, Priority support and the profile, seat and publishing limits displayed at the time of purchase. Seats include the account owner. Publication allowances are shared across the account, rather than provided separately to each profile or member.
We may introduce, change or discontinue plans and plan features. If a material change adversely affects a paid subscription during its current billing period, we will use reasonable efforts to provide notice or preserve the applicable feature until the end of that period.
8. Starter plan and earlier trials
The Starter plan does not require a card. New Pro subscriptions do not include a free trial. If you began a trial under an earlier offer, its original end date and terms continue to apply.
9. Billing and payment
9.1 Subscription fees and access
Paid subscriptions are billed in advance for the monthly or yearly period and amount shown at checkout. New paid access starts after payment is confirmed. Preparing a checkout, receiving an invoice, approving a request that has not yet been confirmed, or reporting a bank transfer does not by itself confirm receipt of funds. Existing trials begun under an earlier offer retain their original terms. Renewal grace periods are described in section 10.
9.2 Payment methods
- Cards and supported digital wallets: Whop, Inc. processes these payments under its Buyer Terms. Its merchant-of-record role is limited to payment processing; Topaz Interactive supplies tenders.gy. Your statement may identify Whop as the processor. By confirming a recurring card subscription, you authorise the processor to store the payment credentials and collect the charges disclosed at checkout until cancellation.
- MMG Mobile Money: we send a payment request to the wallet number you provide. You must approve each payment in MMG. Choosing to save a wallet authorises future renewal requests to that number, not an automatic debit without your approval. Do not enter your MMG password, PIN or one-time approval code on tenders.gy.
- Bank transfer: available for the monthly or yearly prices shown at checkout. You make the transfer using your bank and report it from checkout or Billing. A bank transaction reference or receipt is optional, and we verify the funds before confirming payment. Issuing an invoice does not authorise a debit from your bank account.
Keep your billing information current and use a payment method you control or are authorised to use. Available payment methods and changes are shown in Billing. Switching methods does not reverse a payment already made; any duplicate payment or uncertain outcome must still be reconciled.
9.3 Taxes and currency
Review the final amount and currency shown before confirming payment. Unless stated otherwise, prices exclude taxes, duties or bank charges for which you are legally responsible. Your bank or provider may apply currency conversion or other charges under its own terms.
9.4 Failed or unconfirmed payments
For recurring cards, we or the processor may retry payment where authorised. MMG payments continue to require approval, and bank transfers require your action. Paid features may be restricted when payment is not confirmed, subject to the renewal grace period below. A failed or expired checkout does not itself establish that payment was received. Contact support if you were debited but the payment remains unconfirmed.
10. Renewals, cancellation and plan changes
10.1 Renewal depends on the payment method
Card subscriptions normally renew by automatic charge each billing period until cancelled. For MMG, saving a wallet allows us to send another approval request when renewal is due; you approve that payment in MMG. Without a saved wallet, use Billing to arrange the next payment. Bank-transfer subscriptions require a new manual transfer for each renewal.
For renewable bank-transfer subscriptions, we normally prepare renewal invoices from seven days before a monthly renewal and 30 days before a yearly renewal. Payment is due at the end of the current paid period. The invoice and Billing page show the applicable payment details and dates.
10.2 Five-day grace period for bank transfer and MMG
Eligible bank-transfer and MMG subscriptions awaiting renewal payment retain paid access for five days after the current paid period ends. The grace deadline is shown in Billing. If renewal payment is not confirmed by that deadline, the subscription is cancelled and paid access ends. This is a payment grace period, not a free trial, and it does not apply to a subscription already cancelled for the end of its paid period. Card retry and access handling follows the applicable card subscription and processor rules rather than this manual-payment grace period.
Paying during grace normally renews from the original renewal date, not from the later payment date. A receipt upload or “I have paid” report does not by itself extend the grace deadline. Allow time for the transfer and verification.
10.3 Cancellation and changes
You may cancel through the available Plan and billing controls or by contacting support. Cancellation normally takes effect at the end of the current paid period. It stops future card renewals or scheduled MMG renewal requests and further bank-renewal invoices, subject to payments or requests already initiated. Paid features normally remain available until that period ends unless a refund or another permitted action changes your access.
Disabling an alert channel, removing a saved wallet, uninstalling the web app or requesting deletion is separate from cancelling a subscription. A refund request is also separate from cancellation. Confirm the subscription status in Billing or with support.
Upgrades may take effect immediately and may result in an immediate or prorated charge. Downgrades normally take effect at the end of the current billing period. Review the effective date and charge shown in Billing. Refund eligibility is governed by our Refund and cancellation policy and applicable law.
11. Price changes
We may change plan prices from time to time. A price change for an existing subscription will normally apply from a future renewal after we provide reasonable notice. Continuing the subscription after the new price takes effect constitutes acceptance of the new price.
12. Acceptable use
You agree not to:
- use the Service for an unlawful, fraudulent, deceptive, abusive or harmful purpose;
- misrepresent your identity, organization, qualifications or relationship with a buyer or supplier;
- gain or attempt to gain unauthorized access to the Service, another account, data or connected systems;
- interfere with, overload, probe, scan, damage or disrupt the Service or its security controls;
- upload or transmit malware, harmful code or material that infringes another person’s rights;
- scrape, crawl, harvest or use automated means to extract Service data without our express written permission;
- copy, sell, sublicense, republish, syndicate or redistribute a substantial part of the Service or its compiled data without our written permission;
- share account credentials, evade seat or usage limits, or allow access by people outside your authorized organization;
- reverse engineer, decompile or attempt to discover non-public source code, models or technical protections, except where applicable law expressly permits it; or
- use the Service or its data to build, train or improve a competing tender aggregation, matching or monitoring product without our written permission.
13. Content you provide
You retain ownership of business profiles, notes, feedback, tender information and other content you submit to the Service (“User Content”). You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, format and display User Content only as reasonably necessary to operate, secure and improve the Service and provide the features you request.
You represent that you have the rights and authority needed to provide User Content and that it is accurate and lawful. Do not upload confidential procurement material, personal data or third-party content unless you are authorized to do so.
New customer tender submissions and their documents remain private while in draft or review. You must be authorised to publish for the buyer and provide accurate contact details, requirements and deadlines. Staff review the notice and buyer authority before publication; submitting a notice does not guarantee approval or immediate publication. Approved notices, contact information and attached documents become public procurement content. Changes to a published notice also require review; the existing published version remains public while those changes are reviewed.
A new tender uses one publication from the account allowance when first approved and published. Drafts and updates to that same notice do not use another publication. Allowances reset each calendar month in Guyana, do not roll over and have no cash value. Withdrawing a published notice does not restore its used allowance. We may reject, require corrections to or remove content that is inaccurate, unauthorised or contrary to these Terms.
If you submit ideas or feedback about the Service, we may use them without restriction or compensation, provided we do not publicly identify you without permission.
14. Our intellectual property
The Service—including our software, design, branding, original text, summaries, data organization, matching methods and functionality—is owned by or licensed to Topaz Interactive and is protected by applicable intellectual property laws.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable and revocable licence to use the Service for your own internal business purposes during the period in which you are entitled to access it. No other rights are granted.
Original tender notices, procurement documents, names, logos and other third-party source material remain the property of their respective issuers or rights holders.
15. Privacy
Our Privacy policy explains how we collect, use and protect personal information. By using the Service, you acknowledge those practices.
16. Third-party services
The Service may depend on or link to third-party websites, portals, messaging services, payment processors, documents and other services. We do not control them and are not responsible for their content, availability, security, policies or actions. Your use of a third-party service may be governed by separate terms.
17. Suspension and termination
You may stop using the Service at any time. We may suspend, restrict or terminate access where we reasonably believe that you have violated these Terms, failed to pay fees, created a security or legal risk, abused the Service or could cause harm to us, another user or a third party.
Where practical, we will provide notice and an opportunity to correct the issue. We may act immediately where necessary to protect the Service, comply with law or prevent harm. Termination does not remove payment obligations incurred before termination.
18. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided “as is” and “as available”. We disclaim express and implied warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement and uninterrupted or error-free operation.
We do not guarantee the availability, accuracy, completeness or timeliness of procurement information, AI matches, alerts, external documents or any outcome from using the Service.
19. Limitation of liability
To the fullest extent permitted by law, Topaz Interactive and tenders.gy will not be liable for indirect, incidental, special, consequential, exemplary or punitive loss, or for loss of profit, revenue, opportunity, contract, goodwill or data arising from or related to the Service.
Our total aggregate liability for claims arising from or relating to the Service will not exceed the greater of: (a) the amount you paid to us for the Service during the 12 months before the event giving rise to the claim; or (b) GYD 15,000. These limits apply regardless of the legal basis of the claim.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
20. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Topaz Interactive, tenders.gy and their personnel from third-party claims, losses and reasonable expenses arising from your unlawful use of the Service, your User Content, your violation of these Terms or your infringement of another person’s rights.
21. Changes to the Service or these Terms
We may update the Service and these Terms as our products, business or legal obligations change. We will publish revised Terms with a new effective date and provide additional notice where a change is material. Your continued use after updated Terms take effect constitutes acceptance of them. If you do not agree to a material change, you may cancel before it takes effect.
22. Governing law and disputes
These Terms are governed by the laws of Guyana, without regard to conflict-of-law principles. The courts of Guyana will have exclusive jurisdiction over disputes arising from or relating to these Terms or the Service, unless applicable law requires otherwise.
23. General provisions
These Terms and the policies incorporated by reference form the entire agreement between you and us concerning the Service and replace prior discussions or agreements about it. If any provision is found unenforceable, the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver of it.
You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms as part of a merger, reorganization, sale of assets or transfer of the Service. Neither party is liable for delay or failure caused by events beyond its reasonable control.
24. Contact
Questions about these Terms may be sent to hello@tenders.gy or directed to Topaz Interactive in Georgetown, Guyana.
Notes and team discussions
All Pro options include private notes on tracked tenders and searches and discussions shared within authorised Business Profiles, with replies, mentions, pinning and resolution. You are responsible for content you post and for choosing private or team visibility. Sharing a search does not share its private notes. Notes do not change the official tender notice, deadlines or procurement requirements. A resolved discussion is a team workflow status, not confirmation that an official procurement requirement has been met.
Team access and new contributions depend on the current subscription and profile permissions. A downgrade preserves existing notes; the account owner can recover or export accessible records through the Notes archive. Removing a saved item does not permanently delete its notes.
